1. Agreement

These Terms of Use ("Terms") govern your use of lightfuyrgames.com (the "Site") and any player account, beta access program, or newsletter service operated by Lightfury Games Private Limited ("the Company"). By using the Site or creating an account you accept these Terms. Nothing in these Terms limits your statutory rights under the laws of your country of residence.

2. What the Site Is

lightfuyrgames.com is the studio website of the Company, a game development studio building Lumenfall, an AI-generated open-world RPG. The Site provides information about the studio and its games, a development blog, a player account portal for beta access, and a newsletter sign-up. The Company sells games through third-party storefronts (such as Steam and Epic Games); sales are governed by those storefronts' own terms of service.

3. Use of the Site

• You must be of legal age in your jurisdiction, or have the consent of a parent or guardian, to use the Site and create a player account.
• You agree not to use the Site for any unlawful purpose, to interfere with its operation, or to attempt unauthorised access to any account, system, or network.
• You may not scrape, reverse-engineer, frame, or copy any part of the Site except as permitted by mandatory law or with our express written consent.

4. Intellectual Property

The Site, its content, and all intellectual property relating to Lumenfall and the Company's generative-AI game technology are owned by the Company or its licensors and are protected by Indian and international intellectual-property law. We grant you a limited, personal, non-exclusive, non-transferable licence to access and use the Site for its intended purpose: learning about the studio and its games, accessing beta programs you have been invited to, and reading the development blog.

5. User Content

If you submit content through the Site (for example, a contact form message or beta feedback), you are responsible for ensuring you have the right to share that content. You grant the Company a limited licence to use, store, and process that content solely to respond to you and operate the Site. We will not use your feedback or messages for marketing without your consent.

6. Beta Access

Lumenfall is in active development. Beta access is provided on an invitation basis. Beta builds are pre-release software and may contain bugs, incomplete features, or unexpected behaviour. By participating in a beta program you agree not to publicly disclose non-public game content, assets, or build details that the Company has not cleared for public release.

7. Disclaimers

The Site and any pre-release game builds are provided on an "as is" and "as available" basis. The Company disclaims all warranties to the maximum extent permitted by applicable law. Mandatory consumer warranties applicable in your country of residence are not affected by this disclaimer.

8. Limitation of Liability

To the maximum extent permitted by applicable law, the Company's total liability for any claim arising from or related to the Site will not exceed INR 1,000 (or equivalent), except for liability that cannot be limited under mandatory law in your jurisdiction. The Company is not liable for any loss of game progress, data, or access arising from pre-release software instability.

9. Indemnification

You agree to indemnify and hold harmless the Company from any claims, losses, or costs (including reasonable legal fees) arising from your use of the Site, your breach of these Terms, or your violation of any third-party right.

10. Termination

We may suspend or terminate your account or access to the Site for breach of these Terms, misuse of a beta program, or any conduct that we reasonably consider harmful to the studio or other users. Provisions that by their nature should survive termination (including intellectual property, disclaimers, and limitation of liability) will survive.

11. Governing Law and Jurisdiction

These Terms are governed by the laws of India. Disputes arising out of or in connection with these Terms are subject to the non-exclusive jurisdiction of the competent courts in Hyderabad, India, without prejudice to any mandatory consumer-protection rights you may have in your country of residence.

12. Changes and Contact

We may update these Terms as the studio grows and our services evolve. Material changes will be posted with a new "Last updated" date. Continued use of the Site after that date means you accept the updated Terms.
